Answer: Usana didn’t win against Barry. Despite all the grandstanding by executives about the alleged “lies” told by Barry and the rest of us who worked with Fraud Discovery Institute on the Usana Health Sciences (NASDAQ:USNA) case, Barry actually won. Usana has not proven that anything in our original or subsequent reports constituted lies or misrepresentations.
The court totally shot down the claims Usana made against Barry. Here’s a summary of all the Usana claims dismissed by the court. Their lawsuit was gutted by the judge and Usana is left with next to nothing to pursue.
And the court ordered Usana Health Sciences to pay Barry Minkow’s legal fees, to the tune of $142,510.
Obviously, this was all a huge win for Barry Minkow and team!
